Terms of Service and B2B Sale
These terms govern professional and Athlete use of Wodzilla, including accounts, subscriptions, taxes, Energy, workspaces, content, sharing, AI features, and data processing.

1. Purpose
These Terms of Service and B2B Sale form the contract between POWERSPOT, a French SARL registered under SIREN 878 966 639 and trading as Wodzilla, and both the professional customer using the Wodzilla SaaS service and each individual user, including a user with an autonomous Athlete account, for the provisions governing their access and use. Sale, payment, and professional-customer provisions apply only to professional customers.
Wodzilla plans and paid services are offered only for professional purposes. By creating a professional account, ordering a plan, or using the service for professional purposes, you accept the current version of these terms and confirm that you are at least 18 and authorized to bind the relevant business or organization.
By creating an autonomous Athlete account, you accept the provisions that apply to Athlete users and confirm that you are at least 16. If you are 16 or 17, you also confirm that you have parental or legal-guardian authorization where required. A person under 16 cannot create an autonomous account and may appear only in a profile managed by an authorized coach, responsible organization, parent, or guardian, with data minimized and preferably identified by an alias.
2. Access to the service
Wodzilla is available through pro.wodzilla.app, wodzilla.app, and certain public sharing links. Some features require an account, an active plan, sufficient Energy, or workspace permissions.
We may evolve, suspend, or remove certain features for security, maintenance, product improvement, compliance, or technical reasons.
3. User account
You must provide accurate information, keep your credentials confidential, and notify us if your account is used without authorization.
You are responsible for actions performed from your account, unless the issue results from a failure attributable to Wodzilla.
An Athlete may hold an autonomous Athlete account from age 16 under the authorization rules in Section 1. A person under 16 may be represented only through an authorized coach, responsible organization, parent, or guardian, with data minimized and preferably identified by an alias.
4. Google sign-in
You may sign in with Google if this option is available. This flow is used only to authenticate you and retrieve the basic profile information needed for your Wodzilla account, such as email, name, and profile picture.
Your use of Google remains subject to Google's own terms and policies.
5. Plans, subscriptions, and Energy
Wodzilla may offer free or paid plans, usage limits, a weekly Energy allowance, and Extra Energy purchases. Available limits, prices, and features are displayed in the application at the time of use or purchase.
Included Energy refreshes weekly according to the period shown in the application; unused included Energy does not roll over. Included Energy is spent before purchased Extra Energy. Extra Energy does not disappear at the weekly refresh and remains attached to the purchasing account or Team workspace while it exists.
Energy is a contractual unit used for specified AI features, not money or a stored-value product. It cannot be transferred, exchanged for cash, or moved between personal and Team balances. The Energy cost is shown before an action and may change prospectively; a failed action is restored where the product records that no billable result was delivered.
6. Payment and billing
Prices for subscriptions, Team seats, and Extra Energy top-ups are displayed excluding VAT and other taxes unless expressly stated otherwise. Stripe calculates applicable taxes at checkout from the billing address, country, and valid tax identifier supplied by the customer. The customer is responsible for accurate and current billing information.
Payments, payment methods, invoices, automatic tax calculation, and technical refunds are managed by Stripe. Wodzilla does not store full card numbers. Monthly subscriptions are charged in advance and renew automatically for successive monthly periods until cancelled.
B2B invoices are due immediately through Stripe unless an invoice expressly states another due date. No discount is granted for early payment. Any overdue amount automatically bears late-payment interest, without prior reminder, at the European Central Bank refinancing rate applicable to the relevant period plus ten percentage points, together with the statutory fixed recovery charge of EUR 40 per overdue invoice. Additional documented recovery costs may be claimed when they exceed that fixed charge.
Cancellation is available through the billing portal and takes effect at the end of the paid period. Except where mandatory law applies or Wodzilla expressly agrees after a duplicate charge or proven technical error, paid periods, unused seats, unused included Energy, and granted Extra Energy are not refundable or creditable. Extra Energy already consumed cannot be refunded.
7. Team workspaces
A Team workspace lets multiple users collaborate on shared content, calendars, libraries, clients, resources, and settings. Roles and permissions defined in Wodzilla determine what each member can view or modify.
The owner and admins of a workspace are responsible for managing members, invitations, seats, shared content, and access rights. When a member leaves a Team, some content may remain attached to the workspace depending on its nature.
Team plans are billed per active purchased seat, subject to the minimum and maximum displayed when ordering. The workspace owner is responsible for the selected seat quantity and subscription.
Cancellation takes effect at the paid-period end and does not dissolve the Team. The Team remains fully active until that date, then becomes read-only for a seven-day grace period before moving to a read-only archive. During grace, the owner may reactivate or transfer ownership to an eligible Admin. In an archive, the owner may reactivate the same workspace or permanently dissolve it, while non-owner members may leave.
Permanent dissolution is a separate, irreversible, recently authenticated owner action. It deletes the Team's shared Library, Schedule, branding, public links, Team leaderboards, guest results, and Team-only content; it does not delete members' personal spaces or profiles. Approved minimal authenticated-Athlete history may remain privately without Team context. Remaining Team Extra Energy is forfeited and recorded, and legally required minimized financial and deletion evidence may be retained.
8. User content
You keep your rights over workouts, calendars, analyses, notes, results, clients, texts, branding images, and other content that you add or create in Wodzilla.
You grant Wodzilla a non-exclusive, worldwide license necessary to host, back up, display, process, transform, export, share, and transmit this content to provide the service.
You confirm that you have the necessary rights over imported or shared content and agree not to publish unlawful, discriminatory, dangerous, infringing, or privacy-infringing content.
Wodzilla does not systematically review, verify, validate, or approve workouts, results, comments, client records, or other user content. The author and the professional organization remain responsible for its legality, accuracy, safety, and use. Wodzilla may investigate, restrict, anonymize, or remove content that appears unlawful, dangerous, infringing, abusive, or contrary to these terms, without creating a general monitoring duty.
9. AI generation and analysis
Wodzilla AI features produce programming suggestions, analyses, reformulations, or decision-support content. These outputs may contain errors, approximations, or recommendations unsuitable for a given audience.
You remain responsible for reviewing, adapting, and validating all generated content before using, publishing, or sending it to athletes, clients, or members. Wodzilla does not replace the professional judgment of a qualified coach, healthcare professional, or sports safety expert.
10. Public shares and exports
Wodzilla lets you generate public links, shared pages, PDF/JPG exports, public calendars, and projection views. Anyone with access to a public link can view the corresponding content while the link remains active.
You are responsible for checking publicly shared information, deleting or regenerating links when needed, and not sharing personal data without an appropriate legal basis or consent.
11. Prohibited uses
You agree not to use Wodzilla to:
- Violate the law, third-party rights, or rules applicable to your activity.
- Attempt to access accounts, workspaces, data, APIs, or systems without authorization.
- Circumvent plan, Energy, seat, security, or billing limits.
- Disrupt the service, run excessive loads, abusive automation, or unauthorized tests.
- Share dangerous, hateful, fraudulent, unlawful, malicious, or privacy-infringing content.
- Use Wodzilla as the sole source for medical, nutritional, safety, or performance decisions without appropriate professional evaluation.
- Use Wodzilla as a medical record or store health, medical, biometric, or other sensitive data that is not strictly necessary for ordinary sports programming.
12. Wodzilla intellectual property
Wodzilla, its interface, design, texts, logos, trademarks, components, workflows, code, data models, and product elements are protected by applicable intellectual property rights.
Nothing transfers ownership of Wodzilla to you. You receive only a limited, personal or professional, non-exclusive, non-transferable, and revocable right to use the service under these terms.
Third-party names and trademarks
CrossFit and HYROX, and their associated names and logos, are trademarks of their respective owners. POWERSPOT and Wodzilla do not own those marks and are not affiliated with, endorsed by, sponsored by, or officially connected to their owners.
References to CrossFit or HYROX describe workout disciplines or user-selected programming contexts only. They do not grant a right to use third-party logos or imply certification, affiliation, or approval.
13. Personal data
Personal data processing is described in the Wodzilla Privacy Policy at wodzilla.app/privacy. POWERSPOT is controller for account, billing, support, security, and service-operation data. For athlete, client, employee, or member data entered or imported by a professional customer, the customer is controller and POWERSPOT is processor under the following Data Processing Agreement.
Appendix A — Data Processing Agreement: scope and instructions
This Data Processing Agreement (DPA) is incorporated into these terms and applies whenever POWERSPOT processes personal data on behalf of the professional customer. Its subject matter is the hosting and operation of Wodzilla; its duration is the service relationship plus the deletion or return period; and its purpose is to create, organize, analyze, schedule, and share sports programming and related client information on the customer's documented instructions.
Data subjects may include the customer's athletes, clients, prospects, staff, contractors, and workspace members. Data may include identity and contact details, avatars, sports categories, workouts, schedules, results, scores, notes, and technical identifiers. The customer must not instruct Wodzilla to process medical records or unnecessary special-category data.
The customer determines the lawful purposes and legal bases, gives required notices, obtains any required authorizations, respects data-minimization rules, handles data-subject requests as controller, and ensures its instructions comply with law. POWERSPOT processes the data only on documented instructions, including those expressed through normal product use, unless EU or Member State law requires otherwise.
If EU or Member State law requires processing outside those instructions, POWERSPOT will inform the customer before processing unless that law prohibits notice for important public-interest reasons. POWERSPOT will immediately inform the customer if it considers an instruction to infringe applicable data-protection law.
Appendix A — Confidentiality, security, and incidents
POWERSPOT limits access to authorized persons bound by confidentiality and maintains measures appropriate to the risk, including access controls, tenant and workspace authorization, encryption in transit, managed hosting and database controls, logging, backups, vulnerability and dependency maintenance, and incident procedures.
POWERSPOT will notify the customer without undue delay after becoming aware of a personal-data breach affecting customer-controlled data and will provide reasonably available information for the customer's legal assessment and notification duties. The customer remains responsible for its user permissions, exports, public links, devices, credentials, and the content it chooses to enter.
Appendix A — Subprocessors, transfers, assistance, and end of service
The customer generally authorizes the subprocessors that may handle customer-controlled data, currently Supabase (database and storage), Vercel (hosting, delivery, and technical logs), and, when the customer requests an AI feature, OpenRouter plus the selected model provider, including OpenAI where applicable. Stripe and Google process billing or optional OAuth data for POWERSPOT's controller activities and do not ordinarily receive the customer's athlete or client dataset.
POWERSPOT remains responsible for imposing equivalent data-protection obligations on subprocessors. It will give the customer reasonable prior written notice, by email or in-product notice, of any intended addition or replacement, with enough information and time to raise a substantiated data-protection objection before the change takes effect. If the parties cannot resolve the objection, the customer may stop the affected feature or terminate the affected service. Urgent security changes may be notified as soon as reasonably possible. Where data is transferred outside the EEA, POWERSPOT relies on an adequacy decision, standard contractual clauses, or another valid transfer mechanism.
Taking into account the nature of the processing, POWERSPOT will provide reasonable assistance with data-subject requests, security, breach assessments, impact assessments, and regulator consultations. At the customer's choice when the service ends, POWERSPOT will return or delete customer-controlled personal data and delete existing copies, subject to the documented retention periods in the Privacy Policy, mandatory legal retention, and isolated rolling backups that are not restored for ordinary use.
POWERSPOT will make available the information needed to demonstrate compliance with this DPA and allow and contribute to reasonable audits, including inspections, by the customer or its mandated auditor. Audits require reasonable prior notice and must protect confidentiality, security, other customers, and service continuity; the customer bears reasonable costs beyond standard compliance assistance unless the audit reveals a material breach by POWERSPOT.
14. Availability and maintenance
We make reasonable efforts to keep Wodzilla available, performant, and secure. The service may nevertheless be interrupted or degraded for maintenance, incidents, force majeure, third-party provider intervention, infrastructure changes, or network issues.
Wodzilla is provided as is to the extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or perfectly suited to every use.
Neither party is liable for delay caused by an event beyond its reasonable control, provided it informs the other party where practicable and takes reasonable steps to limit the effects.
15. Liability
Wodzilla does not author, prescribe, or systematically verify user-created workouts or results. To the extent permitted by law, POWERSPOT is not liable for indirect loss, lost revenue or opportunity, user-content errors, decisions based on unreviewed AI output, or misuse of the service.
For all claims arising in a twelve-month period, POWERSPOT's aggregate contractual liability is limited to the fees excluding tax paid by the customer during the twelve months before the event giving rise to the claim. This cap and the exclusions above do not apply where liability cannot legally be limited, including fraud or wilful misconduct, gross negligence, bodily injury caused by POWERSPOT, or mandatory data-protection liability.
You may be liable for violating these terms, abusive use, unlawful content, or harm caused to Wodzilla, another user, or a third party.
16. Suspension and termination
You may stop using Wodzilla or delete your account using the options available in the application. Deletion may permanently remove associated content and data.
We may suspend or terminate access to all or part of the service in case of terms violation, security risk, fraud, unpaid fees, abuse, legal request, or behavior that endangers the service or other users.
Where reasonably possible, we will give notice and an opportunity to remedy before terminating for breach. Immediate restriction remains possible for urgent security, legal, payment-fraud, or third-party-risk reasons.
17. Changes to the terms
We may update these terms to reflect product, pricing, provider, security, or legal changes. The version and effective date displayed at the top identify the applicable contract. Material adverse changes will be notified through an appropriate channel before they take effect where reasonably possible.
Continued use after the effective date constitutes acceptance for future service use. A price change applies no earlier than a subsequent billing period after appropriate notice; the customer may cancel before renewal.
18. Governing law
These terms are governed by French law. The parties will first attempt in good faith to resolve a dispute after written notice. For disputes between parties having merchant status, the Commercial Court of Nanterre has exclusive jurisdiction; otherwise, jurisdiction follows mandatory procedural rules.
